By registering as a member of the Platform, you expressly consent to the following, subject to applicable state laws:

  • Solicitation by Advertisers: You agree to receive marketing communications, promotions, and solicitations from My Legal AI and third-party advertisers partnered with My Legal AI, subject to opt-in consent where required by state law (e.g., Minnesota, Maryland, New Jersey, Nebraska, Tennessee). These communications may include emails, text messages, or phone calls, in compliance with the federal Telephone Consumer Protection Act (TCPA).
  • Sharing of Contact Information: You authorize My Legal AI to share your contact information (e.g., name, email, phone number) with third-party advertisers for marketing purposes, which may constitute a "sale" of personal data under certain state laws. Such sharing is subject to your opt-in consent for sensitive data in states like Minnesota, Nebraska, New Jersey, and Tennessee, and you may opt out as described below.
  • Opt-Out Option: You may opt out of receiving marketing communications or having your information sold or shared with advertisers by updating your account preferences, visiting our "Your Privacy Rights" page at www.mylegalai.com/privacy, or contacting us at support@mylegalai.com. We honor universal opt-out mechanisms (e.g., Global Privacy Control) as required by state law (e.g., California, Delaware, New Hampshire, New Jersey, Tennessee). Note that opting out may not affect communications already initiated by third parties.
  • AI Training: You consent to the collection, use, and processing of your personal information for training our AI models to enhance service quality. This processing complies with applicable data protection laws, and you may withdraw consent by contacting support@mylegalai.com, though this may limit access to certain features.

6. Payment and Fees

Certain features of the Platform require payment of subscription fees. By subscribing to our services, you authorize My Legal AI to charge your credit card on file on a recurring basis, specifically monthly, until you cancel your subscription. You agree to provide and maintain accurate and complete billing information, including a valid credit card. If your payment method fails or is declined, we may suspend your access to the services until the issue is resolved.

6.1 Billing Cycle

Your credit card will be charged automatically each month on the first of the month, or as otherwise specified in your subscription plan. The amount charged will be the then-current subscription fee, which may change upon 30 days' notice from My Legal AI. All fees are non-refundable unless otherwise required by state law.

6.2 Cancellation

To cancel your subscription, you must provide written notice at least 15 days before the next billing date. Cancellation requests can be submitted via email to support@mylegalai.com or through your account settings. Upon cancellation, your access to subscription-based services will be terminated, and no further charges will be made. There are no refunds for payments already made, except as required by law (e.g., California consumer protection laws).

6.3 Updates to Payment Information

You are responsible for keeping your payment information up to date. If your credit card expires or is updated, you must provide new card details to ensure uninterrupted service.

6.4 Notices

We will provide at least 30 days' notice before any changes to the payment date or amount. Notices will be sent to the email address associated with your account.

6.5 Compliance

All payments are subject to applicable U.S. laws and regulations.

Users may not reproduce, distribute, or create derivative works from the Platform's content without prior written consent from My Legal AI.

8. Privacy Policy

Your use of the Platform is subject to our Privacy Policy, which governs the collection, use, and disclosure of your personal information, including sharing with third-party advertisers as outlined in Section 4. 9. Termination

My Legal AI may suspend or terminate your access to the Platform at its sole discretion, with or without cause, including for violations of these Terms, subject to applicable state laws. Upon termination, your right to use the Platform ceases, and My Legal AI may delete your account and associated data within legally mandated timeframes.

10. Limitation of Liability

To the fullest extent permitted by law, My Legal AI, its affiliates, officers, directors, employees, agents, and shareholders shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising out of or related to your use of the Platform, whether based on contract, tort, or other legal theory, except where prohibited by state law (e.g., California, New York). In no event shall My Legal AI's total liability exceed the amount paid by you, if any, for accessing the Platform.

11. Indemnification

You agree to indemnify and hold harmless My Legal AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your intentional misuse of the Platform, violation of these Terms, or infringement of any third-party rights, except where caused by My Legal AI's negligence.

12. Dispute Resolution and Arbitration

⚠️ PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR PURSUE CLASS ACTIONS.

(a) Agreement to Arbitrate: You and My Legal AI agree that any claim, dispute, or controversy arising out of or relating to these Terms or your use of the Platform (collectively, "Claims"), including those related to the sale or sharing of your personal data, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this Agreement, except where state law permits litigation in court (e.g., California PAGA claims). Copies of the AAA Rules are available at www.adr.org.

(b) Class Action Waiver: You and My Legal AI agree to bring Claims in arbitration only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding ("Class Action Waiver"). The arbitrator shall have no authority to consider or resolve Claims on a class, collective, or representative basis.

(c) Representative PAGA Waiver: To the fullest extent permitted by law, you and My Legal AI agree not to bring representative actions under the California Private Attorneys General Act (PAGA), California Labor Code § 2698 et seq., in court or arbitration.

(d) Location of Arbitration: Arbitration hearings will take place in St. Johns County, Florida, unless you and My Legal AI agree otherwise.

(e) Exceptions to Arbitration: This Arbitration Agreement does not apply to: (1) small claims actions brought on an individual basis within a small claims court's jurisdiction; (2) representative PAGA claims deemed unenforceable; (3) claims not subject to arbitration under generally applicable law not preempted by the Federal Arbitration Act; or (4) individual claims of sexual assault or harassment related to Platform use.

13. Force Majeure

My Legal AI shall not be liable for any failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, pandemics, or governmental actions.

14. AI and Privacy Disclosures

  • Nationwide AI Disclosure: You will receive a clear notice (e.g., pop-up, banner) at the start of any AI interaction, indicating that the output is AI-generated and for informational purposes only, requiring verification by a licensed attorney.
  • Data Privacy: We process personal and sensitive data in accordance with our Privacy Policy, using encryption and anonymization where feasible. You may opt out of data sharing or profiling by contacting support@mylegalai.com.
  • State-Specific Disclosures: We comply with AI and privacy laws in California, Colorado, Utah, Minnesota, Maryland, Texas, and other states by providing clear disclosures, opt-out rights, and conducting risk assessments where required.

15. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and My Legal AI regarding the Platform.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect, subject to state-specific consumer protections.
  • Assignment: You may not assign your rights or obligations under these Terms without My Legal AI's prior written consent.
  • Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
